Mutuals Terms & Conditions

1. Introduction

Welcome to Mutuals. These Terms and Conditions (“Terms”) govern your use of our services and participation in our events. By signing up for our services, you agree to comply with these Terms and acknowledge that you have read and understood them.

2. Scope

These Terms apply to all customers who sign up for our services and attend our events.

3. Anti-Harassment and Discrimination Policy

 

a. Policy Overview: We are committed to creating a safe and inclusive environment for all our customers. We do not tolerate any form of harassment or discrimination, including but not limited to antisemitism (including anti-Zionism), racism, homophobia, transphobia, sexual harassment (verbal or physical), body shaming, bullying, or any other form of discrimination. Mutuals events are specifically for Jews, Jewish 2SLGBTQIA+ people, and allies of the Jewish community. All attendees must adhere to our anti-harassment and anti-discrimination standards. Disrespectful behavior may result in denial of entry, removal from the event, and revocation of your membership, which will deny you access to all future events. 

 

b. Reporting Issues: If you experience or witness harassment, discrimination, or bullying, please report it immediately to the Mutuals Director. Reports should be made in writing to meetmutuals.info@gmail.com as soon as possible. Please write “REPORT” in the subject line and include your full name, a detailed account of the incident, any witnesses, and a description of the perpetrator(s), including their name(s) if known. 

 

c. Consequences: We reserve the right to take legal action, revoke memberships, deny entry, or remove individuals from our events if they breach these Terms & Conditions. This includes any behaviour that violates our anti-harassment and discrimination policies. 

4. Consent to Online Information Verification

 

In order to ensure the safety and integrity of our community, we take steps to verify that all members are accurately represented and trustworthy. This may involve reviewing the social media accounts you provide, as well as other publicly available information, to confirm the accuracy of the details submitted in your application. This process may include, but is not limited to, a review of public police records and social media profiles.

5. Media Release

By attending our event, you consent to:

a. The capture, use, and public release of photos and/or videos featuring you on Mutuals' official channels, as well as those of our contractors, including DJs, videographers, and other media affiliates. If you do not consent to being photographed or recorded, please notify us in writing prior to the event.

6. Plus One Club Specific Policy

a. Description: Non-members are allowed to attend one Mutuals event as a guest through our Plus One Club. After attending, if the Plus One adheres to these Terms & Conditions, they may become a member of Mutuals.​

 

b. Member Responsibilities: The member who invites a Plus One (Member Referral Contact) is responsible for ensuring that their guest adheres to all rules and regulations outlined in these Terms & Conditions. If the Plus One breaches these Terms & Conditions, they will be subject to the consequences outlined in Section 3.c. Additionally, the member who referred this Plus One who breached the Terms, may undergo a review of their membership. The Mutuals Director will handle membership reviews, which may result in a warning or termination of the membership based on the severity of the situation. The Mutuals Director’s decision is final and not subjected to legal proceedings.​


c. Plus One Registration: Members & Plus Ones understand that their applications may take up to 1 week to be reviewed, and that a completion of the sign up form does not guarantee them access to meetmutuals.com. More detailed instructions are outlined in the Members portal under “Invite a Plus One.”

7. Registration and Payment

 

a. Registration: To access our services, you must complete the registration process, including providing accurate and up-to-date information that matches your government-issued ID. Failure to provide correct information may result in denied entry to our event.

b. Payment: Memberships are provided at no cost. The only costs incurred by members and Plus Ones are for tickets to events. Payment for tickets must be made on Mutuals official website; meetmutuals.com. Failure to make payment and provide valid tickets may result in denied entry into our events.

8. Use of Service

a. Permitted Use: You agree to use our services for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations.

b. Prohibited Use: You may not use our services to engage in any unlawful or harmful activities, including but not limited to harassment, discrimination, or the dissemination of inappropriate content.

9. Termination

a. Termination by Us: We reserve the right to terminate or suspend your access to our services if you violate these Terms or if we determine, in our sole discretion, that your behavior is unacceptable.

b. Termination by You: You may terminate your use of our services at any time by notifying us in writing. No refunds will be provided for any unused portion of the service. All tickets are final sale; no refunds, exchanges, or credits will be issued.

10. Copyright

a. Ownership: All content, materials, and intellectual property related to Mutuals, including but not limited to event names, logos, and business models, are the exclusive property of Mutuals.

b. Restriction on Use: If you attend one or more Mutuals events, whether you pay for a ticket or are invited as a guest, you agree not to create or organize any event or business that resembles or is similar to the Mutuals business model, uses the same or similar names, or otherwise infringes on our intellectual property. Any attempt to replicate or mimic our business model or branding is strictly prohibited. Legal action will be taken if these terms are violated.

11. Liability

a. Alcohol & Drug Policy: By attending our events, you acknowledge that we are not liable for any injuries, damages, or fatalities resulting from the consumption of alcohol, cannabis, or any other substances. Additionally, we are not responsible for any individual who chooses to operate a vehicle under the influence of alcohol, drugs, or any narcotics before, during, or after the event. By attending the event, you agree not to smoke or vape any substance inside the venue. Smoking and vaping are permitted only in designated outdoor smoking areas.

b. Venue Liability: We are not responsible for any injuries, damages, or fatalities resulting from structural failures, accidents, or other hazards associated with the venue.

 

c. Anti-Discrimination & Harassment Liability: We are committed to fostering a safe and inclusive environment. While we employ professional security personnel to enhance safety, we are not liable for the actions of third parties, including but not limited to sexual harassment, verbal harassment, physical violence, emotional distress, or any other misconduct that may occur at the event. Attendees are expected to adhere to all applicable laws and our Code of Conduct.

d. Limitation of Liability: To the fullest extent permitted by law, Mutuals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

e. Indemnification: You agree to indemnify and hold harmless Mutuals, its affiliates, officers, employees, contractand agents from any claims, liabilities, personal injuries, damages, losses, or expenses arising out of your use of our services or your violation of these Terms.

12. WAIVER

BY BECOMING A MEMBER AND/OR ATTENDING OUR EVENTS, YOU FREELY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.

BY BECOMING A MEMBER AND/OR ATTENDING OUR EVENTS, YOU AGREE TO WAIVE ANY AND ALL CLAIMS that you have or may in the future have against the MUTUALS AND TO RELEASE MUTUALS from any and all liability for any loss, damage, expense or injury, including death, that you may suffer or that your next of kin may suffer, as a result of you being a member and/or participating at MUTUALS events, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.O. 1990, c. O.2, as amended ON THE PART OF MUTUALS AND FURTHER INCLUDING THE FAILURE ON THE PART OF MUTUALS TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT YOU FROM THE RISKS, DANGERS AND HAZARDS OF BEING A MEMBER AND/OR ATTENDING AND PARTICIPATING IN OUR EVENTS REFERRED TO ABOVE.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the revised Terms on our website or through other communication channels. Your continued use of our services after such changes constitutes your acceptance of the new Terms.

15. Acknowledgment

By signing up for our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

16. Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, regardless of the place of execution and without regard to conflict of law provisions. Any dispute arising from this Agreement shall be resolved exclusively in an Ontario or federal court having jurisdiction sitting in the City of Toronto, Ontario.
